Huemer [33] argues against the killing of animals. I offer a critical libertarian analysis of his claim.

This essay argues that the book of Ruth's reopening of Israel's history and national mythology functions in such a way as to redeem, as it were, the plight of the subaltern Moabite—a plight begun with the daughters of Lot in Genesis 19. A parallel is then drawn with the 1619 Project, the recent journalistic project which posits the entire historical sweep of African slavery in North America since 1619 as the defining arc of the United States' founding. In so doing, the essay illustrates how a “functionalist” approach to biblical ethics that balances the content of the biblical narrative with attention to how the text functions in its broader context can provide guidance for contemporary ethical application. Heumer and I debate animal rights, utilitarianism, libertarianism, morality and philosophy. We agree that suffering is a problem, and diverge, widely, on how to deal with it. I maintain that this author’s reputation as a libertarian, let alone an intellectual leader of this movement, is problematic. Why? That is because libertarianism, properly understood, is a theory of intra-human rights; this philosophy says nothing about right from an extra-human perspective, Heumer to the contrary notwithstanding. Virtues are standardly understood as (1) essentially dispositions to perform certain actions and (2) having only instrumental value as motives to fulfill moral duties which can be fulfilled by persons lacking the virtue because the duties mandate only certain act-types. The argument of this article is that the duties of beneficence, gratitude and self-respect cannot be stated in terms of obligatory act-types because they cannot be fulfilled (except in deficient form) by persons lacking the appropriate virtue; they are, rather, duties (...) to cultivate specific virtues which therefore cannot themselves be defined in terms of obligatory actions. Rawls’s theory of justice has been criticized for allowing individuals by their own voluntary choice to make themselves members of the ‘least advantaged’ class and thereby eligible, albeit undeservedly, for the benefits mandated by the Difference Principle. I argue, first, that this criticism overlooks the fact that the Difference Principle applies only to the lifetime expectations of representative persons and, second, that it is possible to implement the Difference Principle (and the social minimum) through policies that do not create work (...) disincentives or require making objectionable moral judgments about who is and who is not deserving of assistance. Abstract The leadership of the black community is concerned with welfare, with equality, with unemployment, with discrimination, with racism, with the pay gap, and with dozens of other such traditional issues. Oh, yes, they are also apprehensive about the use of addictive drugs. But, as we speak, young male members of this community are being incarcerated at frightful rates, and, even worse, are killing each other to boot. One would think that this latter issue would occupy the interest of black (...) leaders front and center. After all, there are few worse problems than being jailed or killed. The present paper is dedicated to making the case that the black leadership has its priorities all wrong; that if they were to exercise true leadership, they would see the jailing and murder of young black men as perhaps the greatest threat to their community; and, if so, they would fervently support the legalization of all drugs. Its appeal to scientific method requires the construction of a model from which predictions can be made. This model must have the comprehensive character of those proposed by philosophy and the sciences. Such a model is available in the form of war gaming, a traditional military training vehicle transformed in such a way as to (...) make it a research tool of great power and flexibility and which can assume a multitude of forms. The war game as a new research tool, when applied to the important problems at a high level of optimization, carries with it the excitement of a pioneering venture and the promise of contributions of greatly increased importance to the development of military science. Wollen (2022) is a critique of deontological libertarianism, the version of this philosophy predicated upon private property rights and the non-aggression principle. The launching pad for this article of his is the difficulty faced by conjoined twins, who diverge sharply in their view of their desirable future. The present rejoinder maintains that this author’s critique fails; further, that it really has little or nothing to do with conjoined twins per se, but, rather, aims at an entirely different challenge, that of (...) the tie or the dead heat. This latter is a critique that all political economic philosophies face, without exception, and libertarianism does no worse on this challenge than any other, the critique of Wollen to the contrary notwithstanding. This article critically reflects on the research portfolio by the ecological economist Clive Spash who has helped pinpoint specific and systemic blindspots in a political-economic system that prioritises myopic development trajectories divorced from ecological reality. Drawing on his published work and collaborations it seeks to make sense of the slow, or absent, progress in averting global warming and ecological destruction. Three strands of key concern and influence are identified and discussed with reference to their orientation and explicit expression regarding Ontology, (...) Epistemology and Axiology. Some complementary points about indeterminacy and holism are presented to further strengthen the arguments for a transition towards a social-ecological economic system that puts values and principles back into focus. While Clive Spash's work has made a strong case within the economic community and appealing to ecology professionals, the value-myopia or value-vacuum has to be tackled across all disciplines, politics and society for a meaningful and urgently required transformation in decision making. Hence, the article finishes with some suggestions for the (higher) education system, and highlights the importance of simplicity and sufficiency, as well as strong sustainability-driven citizen and community action as necessary catalysts of change in this social-ecological transformation. Discussing philosophy, libertarian property rights theory, reparations and other property rights issues, this volume is of interest to academics, students, journalists and all those interested in this integral aspect of political economic philosophy.

Libertarians and non libertarians alike agree that counterfeiting legitimate money owned by innocent people is illicit. But what about counterfeiting counterfeit money owned by the guiltless? Davidson and I, both libertarians, take the position that this would be a rights violation; that this would violate the rights of innocent owners of currency, who would be victimized by such fraudulent behavior of counterfeiters, even those who limit themselves to counterfeiting counterfeit funds. But what about counterfeiting counterfeit money owned by those who (...) are guilty of crimes? Davidson opines, in effect, that there are no such people. The counterfeiter of counterfeit money is thus himself a criminal, she avers. I argue, very much to the contrary, that the relevant population consists mostly of guilty people, and thus they are not in a logical position to object to what would otherwise be considered victimization. As for the few innocents among them, they demonstrate their innocence to a large degree by not objecting to the counterfeiting of counterfeit money. If they do object, and take actions to prevent this practice, they act in a manner incompatible with the libertarian non aggression principle and thus enter the ranks of the guilty. I find Davidson’s economic analysis impeccable; her understanding of libertarianism highly problematic. In the interests of full disclosure, I should make it clear that the present paper contains the radical suggestion that we should do away with our established monetary- and financial system. If need be, and this is by no means my first choice, we are entitled to do so by means of massive counterfeiting of established currencies. Of course, this is illegal in extant nations, and I would not want to be imprisoned for committing a crime. So, for purposes of our discussion, we will be considering only the imaginary country of Ruritania. (shrink)

Ayn Rand most certainly favored liberty, although she renounced the "libertarian" appellation. Yet, in her continuous, contemptuous and shrill attacks on religion, she was denigrating an institution that has made great contributions to freedom. The present essay is an attempt to right the balance; to demonstrate that religion and liberty are not the enemies supposed by Rand.

We provide a survey of significant libertarian contributions to the discussion surrounding ethics and taxation. By significant contributions, we mean those which have exerted a strong influence both on libertarianism, popular and academic, and on political and ethical discourse more broadly. Our discussion centers on the work of three prominent libertarians: Robert Nozick, Ayn Rand, and Murray Rothbard. For each, we present his or her position concerning some ethical aspect of taxation and evaluate objections to it. Section 4.2 discusses Nozick’s (...) analogy between taxation of labor from earnings and forced labor and applies his argument against the fairness principle to fairness-based justifications of such taxation. Section 4.3 focuses on Rand’s view that compulsory taxation as such is unjust and considers her proposed scheme of voluntarily-funded minimal government. We argue that she failed to convincingly argue for either the feasibility or desirability of the latter. Section 4.4 addresses Rothbard’s similar position concerning the injustice of taxation per se and defends his view against possible justifications of that institution. (shrink)

The essays in this 1987 volume are concerned with ideas of contrarity and other kinds of polar opposition in French literature of the eighteenth century. Originally these ideas were merely part of an impulse to undermine the establishment, but as the century progressed the desire to invert social values and question accepted norms merged with the main groundswell of the age to form part of the movement of Revolution. Professor Rex considers some of the major writers of the period: Diderot, (...) Rousseau, Voltaire, and Beaumarchais. He also explores minor genres such as opéras comiques, theatrical parodies, and erotic or pornographic pieces; these have been largely forgotten, but in their time they imbued the creative life of the era with vitality. In treating the literature in relation to the other arts, especially painting and music, these essays will be of interest to scholars of all aspects of eighteenth-century French culture. (shrink)

Freedom to smoke is part and parcel of overall freedom. The former cannot be abrogated without violating the latter. The present paper applies this insight to the regulations placed on the tobacco industry and smoking in general. We find that government interventions into people’s lives regarding smoking are highly incompatible with libertarian principles. We examine many regulations such as prohibiting youths from smoking, preventing second hand smoke, restrictions on advertising, taxing the industry, and liability issues.

This paper claims that health insurance is not a human right; that the reason the medical care industry is in such an unsatisfactorystate is that there is not enough competition in the field. To wit, there are government interferences on both the supply and demand sides of health care; the former in terms of restrictions on entry for physicians, the latter based on the moral hazard attendant on the subsidization of medicine.
